For what purpose do we process your personal data?

In accordance with the provisions of EU Regulation 679/2016 and Organic Law 3/2018 of 5 December on the protection of personal data and guarantee of digital rights, we inform you that the personal data you provide us and those that are generated during the development of relationship with you, are treated with the following purposes:

  • to attend the requests you make to us
  • To provide you with information about BERIPAN SL products, consenting to the sending of commercial communications by e-mail or by any other equivalent means of electronic communication (such as SMS) that you have provided us.
  • Allow your participation in sweepstakes and or commercial promotions.
  • If you send us a Curriculum, that your candidacy is valued in the realization of personnel selection processes.
  • The sending of communications by any means that you have provided us, related to the activities developed by the entity and that could be of interest to you.
  • The response to queries, complaints and suggestions, and the realization of all kinds of communication actions.
  • The development, fulfillment and execution of a contract of sale or service provision or any other contract between the two.
  • The accounting, fiscal and administrative management of the entity.

How long will we keep your data?

The personal data provided will be kept as long as their deletion is not requested by the person concerned, or whoever legally acts as his legal representative and this is appropriate, and as long as they are necessary – including the need to keep them during the applicable statute of limitations – or relevant for the purpose for which they were collected or recorded.

The conservation of the data will be conditioned to the legal obligation that BERIPAN SL has to keep them. After these deadlines the data will be destroyed or erased, performing the deletion, elimination or destruction so that the information contained in the media is not recoverable.

Legitimation

The legal basis for the processing of your data is the consent given by the person concerned. This is obtained expressly and unequivocally by completing and, where appropriate, sending the documents and paper or electronic forms in which your data is collected. In all documents of the entity, which are used to collect data for different uses, there are informative clauses in accordance with the provisions of the data protection regulations and consent is expressly expressed by the signature of the person concerned, or by sending the existing forms on the website.

It is also a cause of legitimacy when this treatment is necessary for the performance of a contract, or the provision of a service provided to the persons concerned, in which they are party, or for the application at their request of pre-contractual measures (art. 6.1.a and b RGPD).

BERIPAN SL is also entitled to process your data to comply with the legal obligations to which it is subject and for the satisfaction of legitimate interests, provided that the interests or fundamental rights of the persons concerned do not prevail over these.

Whatever the cause of legitimacy, consent may be revoked at any time.

To which recipients will your data be communicated?

Your data will not be disclosed to any entity without your consent, except for the transfers provided for by law. In this regard, your express consent will be requested for the transfer of your data to any other entity.

As a result of the management of the authorized purposes your data may be communicated to entities or persons directly related to BERIPAN SL and the services provided by it. Also, your personal information will be available to public administrations, judges and courts, for the attention of possible liabilities arising from the treatment and provided that these assignments are covered by law.

Your information may also be disclosed to companies that provide us with consulting, IT maintenance, marketing, training or auditing services. These entities only have access to personal information that is necessary to carry out these services, and are required by a “data processing assignment” contract to maintain confidentiality, not to use the information for other purposes, and to take measures to ensure the integrity and availability of the information.

International transfers of data outside the European Union space or to entities that do not meet the standards in terms of data protection established by the EU regulation 679/2016 are not foreseen.

Where does your data come from?

The personal data processed by BERIPAN SL are provided by the person concerned, or obtained from sources accessible to the public.

BERIPAN SL will process the data you provide, which may be of the following categories:

  • Detailed employment data

What are your rights?

Any person has the right to obtain confirmation as to whether or not BERIPAN SL processes personal data concerning him/her.

Interested parties have the right to access their personal data and to obtain a copy of the personal data being processed, to update it, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances and for reasons related to their particular situation, interested parties may object to the processing of their data. BERIPAN SL will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

Also in certain circumstances, provided for in Article 18 RGPD, data subjects may request the limitation of the processing of their data, in which case BERIPAN SL will process them, with the exception of their conservation, with the consent of the data subject or for the formulation, exercise or defense of claims, or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a particular Member State.

If applicable, as a consequence of the application of the right to erasure or objection to the processing of personal data in the on-line environment, data subjects have the right to be forgotten according to the case law of the Court of Justice of the EU.

Under the right to portability, data subjects have the right to obtain the personal data concerning them in a structured, commonly used and machine-readable format and to transmit it to another controller.

Any data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on him or her or similarly significantly affects him or her, subject to the exceptions provided for in Art.22.1 RGPD.

The person concerned has the right to the deletion of his data, due to the disappearance of the purpose for which the data was processed or collected, due to revocation of consent when it is the consent that legitimizes the processing, or for the other reasons contained in Article 17RGPD. The deletion will be carried out by proceeding to the high-level erasure of data contained in automated media and the physical destruction of non-automated media.

How can the rights be exercised?

By means of a letter always accompanied by a copy of the ID card or other document proving the identity of the person concerned addressed to the addresses indicated in the heading.
